Terms and Conditions
Responsibility: COLPITTS WORLD TRAVEL (“CWT”),
875 Providence Highway, Dedham, MA 02026, and sponsoring organization,
acts merely in the capacity of agent for transportation and other travel
service companies and suppliers in selling and arranging travel-related
services and in accepting reservations or bookings for services that are
not directly supplied by CWT (such as air and ground transportation, hotel
accommodations, meals, tours, cruises, etc.). CWT cannot be held responsible
for any events beyond its control, such as (without limitation) illness,
pilferage, acts of God, war (whether declared or undeclared), terrorist
activities, social or labor unrest, mechanical or construction failures
or difficulties, diseases, quarantine, government restraints, local laws,
climactic conditions, machinery breakdown, defect in vehicle or transportation,
criminal or abnormal conditions or developments, or other such events,
conditions, casualty, or misadventure; nor, in the absence of its own negligence,
for personal injury, property damage, loss of earnings, or death, from any
event whatsoever caused by persons not controlled by CWT, such as (without
limitation) airlines, cruise lines, railways, bus companies and hotels and
their agents and employees. Unless the term “guaranteed” is
specifically stated in writing on your tickets, invoice, or reservation
itinerary, CWT does not guarantee any of such suppliers, rates, bookings,
reservations, connections, scheduling, or handling of personal effects.
Under no circumstances does CWT guarantee your safety, or that you will be
free from the risks of personal harm or property loss in connection with
any travel-related services purchased from and/or arranged by CWT. CWT
reserves the right to change tour itineraries and/or any tour component
or components whenever CWT deems such change to be necessary. No carrier
shall be responsible for any act, omission, or event during such time that
the traveler or his/her travel companions are not aboard the carrier's own
conveyance. The traveler assumes complete and full responsibility for and
hereby releases CWT from any duty of checking and verifying any and all
passport, visa, vaccination, or other entry requirements of each destination
and all safety or security conditions at such destinations during the period
of the proposed travel. For information concerning possible dangers at
international destinations, contact the Travel Advisory Section of the U.S.

By embarking upon his/her travel, the traveler voluntarily assumes all risks
involved in such travel, whether expected or unexpected. The traveler is
hereby warned of such risks and is advised to obtain appropriate (accident/health,
baggage, and/or trip) insurance coverage against such risks. No warranties,
representations, terms or conditions apply to any travel-related services
sold and/or arranged by CWT unless expressly stated within these Terms and
Conditions. The traveler's retention of tickets, reservations, or bookings
after issuance shall constitute consent to the above and an agreement on
his/her part to convey the contents hereto to his/her travel companions or
group members. Items included in a travel program that are omitted
voluntarily or involuntarily are non-refundable.
In the event of any claim, dispute or proceeding arising out of this Agreement,
or any claim which in contract, tort, or otherwise at law or in equity arises
between the parties, whether or not related to this Agreement, the parties submit
and consent to the exclusive jurisdiction and venue of the courts of the Commonwealth
of Massachusetts and of the United States District Court for the District of
Massachusetts. For all programs: Credit cards are for deposit only and not
accepted for final payment. Reservations made after final payment due date
must be paid in full within 7 days. Reservations made inside 90 days require
payment in full. Any deviations in travel arrangements, pre or post trip,
must be requested in writing prior to the final payment due date and MAY be
subject to processing fee. Cancellations must be in writing by FAX, telegram,
or registered mail (indicating the reason for cancellation) and received by
the final payment due date to avoid any cancellation charges. Domestic and
international airfares are subject to applicable airline cancellation fees,
which may be in addition to the cancellation fees above. Due to fluctuations
in the cruise lines air contracts airfares may change without notice.
Passengers will be charged for any fare difference. Optional travel insurance
premiums and visa fees (when applicable) are not refundable. The cost of these
vacation packages is based on group promotional tariffs and foreign exchange
rates in effect as of January 1, 2007. All amounts are in US dollars unless
otherwise specified and are per person and based on double occupancy. Enrollment
in these tours and payment of deposits constitute agreement to the above terms
and conditions of travel.
CANCELLATIONS: All cancellations must be in writing
and received no later than 90 days prior to sailing. Penalties for late
cancellations will be assessed as follows: The fee for cancellations received
90- 46 days prior to departure will be $750 per person. The fee for cancellations
received 45- 30 days prior to departure will be 60% of the total price per person.
Cancellations received 29 days or less before day of departure and no shows are
nonrefundable. SPACE IS LIMITED AND WILL BE CONFIRMED ON A FIRST-COME, FIRST-SERVED
BASIS. INSURANCE IS HIGHLY RECOMMENDED. Please contact Colpitts Group Travel
